Крадат ни имейли и лични данни от чужбина

Хакери крадат стотици имейл адреси на българи, които продават на пакети от чужбина. За новата схема е сигнализирана Комисията за защита на личните данни, пише „Монитор“.

За последните две години в Комисията за защита на личните данни са постъпили 30 такива сигнала от опарени граждани.

Всички ужилени са се оказали част от списъци с имейли, които са продадени на търговски дружества или дори на т.нар нигерийски измамници и пощите им са били буквално залети от непоискани електронни съобщения. Въпреки спама обаче се оказва, че нарушение според родното законодателство няма, обясниха от комисията.

Според нормативната уредба, ако в списъците с имейлите няма друга информация като ЕГН-та, адреси и имена, това не е злоупотреба с лични данни, тъй като електронните пощи не се водят такива.

Друга спънка било това, че след промяна на Закона за електронните съобщения през март 2015 г. КЗЛД няма възможност да прави справки кой е източникът, разпространяващ съобщенията.

Въпреки законовите спънки от комисията са поискали съдействие от ГДБОП за идентифициранеи и установяване на хората, които предлагат за продажба тези бази с електронни адреси. До момента няма информация за търговци в страната.

За да се установи такъв човек, на специализираните органи е необходим и достъп до трафични данни, който става само с разрешение от съда, но единствено и само при наличие на данни за престъпления, свързани с националната сигурност и за предотвратяване, разкриване и разследване на тежки престъпления, наказуеми с над 5 г. затвор.

„От получената досега информация е видно, че домейните са хоствани и регистрирани извън територията на страната“, съобщават от комисията. Тя не може да направи нищо, тъй като правомощията й са само на територията на България. Проверка в интернет показа, че офертите за продажба на списъци с имейли могат да се намерят са много.

„Здравейте, продавам списък с имейли на частни лица и на юридически лица. Използва се за имейл маркетинг. Списъкът съдържа 650 000 имейла за 200 лв., актуализиран през януари 2016. Можете да закупите и част от него: 120 000 имейла /фирми и физически лица/ за 60 лв., 200 000 имейла /фирми и физически лица/ за 100 лв., 150 000 имейла /само фирми/ за 150 лв., 500 000 имейла /само физически лица/ за 150 лв.

Имейлите са истински и реални, проверени са в системата за защита на лични данни, и са премахнати имейлите на хората, които не желаят да получат търговски съобщения.

Заедно със списъка получавате безплатно програма за изпращането на мейлите. Програмата се ползва лесно, с нея има инструкции за инсталирането и за работа с нея“, гласи една от рекламите.

Накрая търговецът предлага и списъци с електронни адреси в Гърция – за 400 000 имейла цената е 150 лв., 250 000 имейла в Румъния пък струват 100 лв. А ако някой реши да си купи списъците за България, Гърция и Румъния, трябва да плати 300 лв.

„Имам списъци за други държави, ако Ви интересува попитайте. За поръчки пишете на имейла“, любезно завършва авторът на непоисканото електронно съобщение, идващо от адрес в gmail.

За разлика от търговията с имейли в комисията от години не са постъпвали сигнали за търговия на лични данни. В същото време обаче непрекъснато постъпват оплаквания за злоупотреба с лични данни от застрахователни компании, колцентрове и маркетингови дружества, съобщават от КЗЛД.

Най-честите жалби от граждани са за телефонни обаждания от различни колцентрове, които предлагат определени продукти или за целите на предизборна кампания при предстоящи избори.

В тези случаи потърпевшите искат информация от комисията за начина на придобиване и основанието за използване на телефонните им номера. Тя обаче няма разследващи функции и затова изключително трудно установява първоизточника на базата данни и начина на тяхното придобиване и разпространение, обясняват от комисията.

Когато и ако все пак успее да разбере кой обработва неправомерно лични данни, тя издава задължителни предписания или съставя актове за административни нарушения.

Столичанка разказа как се е опарила от неправомерно разпространение на лични данни. На 10 февруари т.г. тя получила обаждане от номер 02/412 4772. Женски глас потърсил зет й, който е чужденец, за да му предложи някакъв застрахователен пакет.

„Моят зет е чужд гражданин, живее постоянно зад граница, не е идвал в България от десетина години и няма сключвани застраховки във въпросното дружество. Аз също нямам сключвани застраховки там и никога нито аз, нито зет ми по никакъв повод не сме предоставяли на тази фирма лични данни и координати“, обясни опарената столичанка.

„На въпроса ми откъде във фирмата имат телефонния ми номер, кой и как е свързал този номер с двете имена на зет ми, служителката отговори след доста дълга пауза: „Ами от нашия маркетингов отдел“, разказа жената.

Пет дни по-късно тя подала жалба в КЗЛД с въпрос откъде маркетинговият отдел на компанията се е снабдил и притежава лични данни за нея и нейното семейство и с какво право, но все още няма отговор. На жалбата й до застрахователя получила отговор, че данните са взети от Търговския регистър, който е публичен.

„Единственият лист хартия, върху който има данните на зет ми и моя мобилен телефон, е заявление до Агенцията по вписванията за издаване на Булстат през ноември 2015 г. по повод на продажба на жилище. Вероятно служител на агенцията продава лични данни на различни компании“, твърди пострадалата жена.
